General Provisions of the Telephone Consumer Protection Act (TCPA)

- Prohibits solicitors, calling to residences between 9 pm to 8 am.
- Solicitors must maintain a DNC list of all the consumers who have asked not to be called. The request must be honored for at least 5 years.
- All the concerned solicitors must respect the National DNC Registry.
- Solicitors must get themselves registered by providing the name, contact and address details of the person on whose behalf the calls are being made. These contact details can be utilized to approach the concerned person.
- TCPA also prohibits the solicitations to residences that make use of pre-recorded voice messages.
- Prohibits the automatic call dialers to approach emergency numbers (e.g. 911), hospital emergency contact numbers or a physician’s or any other service domain in which the recipient is being charged for the call.
- Prohibits auto-dialing of calls which involve multiple line communication.
- Prohibits unsolicited advertisement-based faxes.
